1. Acceptance of Terms
By accessing or using the Luma Retreats platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. Luma Retreats reserves the right to update these Terms at any time, with changes effective upon posting.
2. Use of the Platform
You must be at least 18 years old to use the Platform. You agree to provide accurate information during registration and to maintain the security of your account credentials. You are responsible for all activity that occurs under your account. Commercial use of the Platform without prior written consent is prohibited.
3. Bookings and Payments
All bookings are subject to host approval (unless Instant Book is enabled). Luma Retreats charges a 10% platform fee on all bookings. Hosts keep 90% of every reservation. Payments are processed securely and funds are released to hosts 24 hours after guest check-in. All prices are displayed in USD.
4. Cancellation Policies
Cancellation terms vary by listing (Flexible, Moderate, Strict, or Super Strict) and are displayed on each property page before booking. Host cancellations may result in penalties and platform credits issued to affected guests. Guest refunds are processed within 5–10 business days.
5. User Conduct
You agree not to use the Platform for any unlawful purpose, to harass or harm other users, to post false or misleading content, to circumvent the Platform to conduct direct payments to hosts or guests, or to attempt to gain unauthorized access to any part of the Platform.
6. Limitation of Liability
Luma Retreats acts as a marketplace connecting hosts and guests and is not responsible for the condition of properties, the conduct of users, or any disputes arising from bookings. To the maximum extent permitted by law, Luma Retreats liability is limited to the total service fees paid by you in the 12 months preceding the claim.
7. Intellectual Property
All content on the Platform — including text, graphics, logos, and software — is the property of Luma Retreats or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.
8. Termination
Luma Retreats reserves the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or conduct harmful to the Platform or its users. You may terminate your account at any time from your Account Settings.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in Miami, Florida.
